LAGOS State High Court sitting in Osborne Foreshore Estate, Ikoyi, has directed banks to freeze the account of Clement Mokedi and others.
Other respondents are ARC Curve Ltd, Gboyega Adewuyi, M&N Properties Ltd and Mr Uche Manu.
Justice R. O. Olukolu restrained the respondents from accessing funds in their accounts pending hearing and determination of the Motion on Notice for Mareva Injunction.
The order followed an ex-parte application in a suit: LD/602CM/2022, filed by Ravins Brook Deliveries, suing as the lawful attorney of Kehinde Bolodeoku through their counsel, Mr. Gbenga Ajala.
The judge gave an order of Mareva injunction restraining the respondents, their agents and privies from utilising, accessing and dissipating funds and proceeds from the purported sale of
Bolodeoku’s Apartment at Unit 12 on the fifth floor of Plot 6, Block 3, Rock Drive, off C&l Leasing Drives, Lekki Phase 1, Lagos State.
The injunction also restrains the respondents from using funds standing to their credit in any account in the banks.
The court further restrained the parties cited/banks from allowing or permitting the respondents’ access to and utilisation of the purported sale of donor/applicant’s apartment and from withdrawing any funds from the respondents’ accounts with the banks.
Ajala informed the court that his client filed an originating motion on notice and the motion ex-parte.
Justice Olukolu held that the circumstance was “deserving” for “an order for the preservation or interim custody of the subject matter of the suit…”
He granted reliefs 1,2,5,6,7,8,9,10 and adjourned until March 16 for a report of service.
